مقدّمة

Welcome to Logisty! These Customer Terms and Conditions (“Terms”) govern your use of our mobile applications, websites, services, and technology platform (collectively, the “Services”). Logisty is a joint initiative between Dubai’s Roads and Transport Authority (RTA) and TruKKer Technologies DMCC (a free zone company registered in the United Arab Emirates), with the objective of offering seamless logistics and transportation services. Headquartered in Dubai, UAE, Logisty leverages RTA’s infrastructure and TruKKer’s expertise to provide efficient logistics services (hereinafter referred to as ‘Logisty’).

1. الاتفاق التعاقدي

These Terms govern your access and use of the applications, websites, content, products, and services provided on Logisty, a collaboration between RTA Dubai and TruKKer Technologies DMCC (TruKKer). By accessing or using the Services, you agree to be bound by these Terms, establishing a contractual relationship between you and Logisty.

تيح منصة Logisty للمستخدمين إمكانية جدولة وترتيب خدمات النقل والخدمات اللوجستية التي يوفرها مزوّدو خدمات مستقلون كأطراف ثالثة ("مزودو الخدمات الخارجيون")، حيث تعمل Logisty كمنصة وسيطة، بينما يتم تنفيذ الخدمات من قبل متعاقدين مستقلين.

3.1 Truck Availability:

Truck availability may vary based on location, demand & availability and other operational conditions. Logisty leverages existing Trukker fleet infrastructure, but specific truck types or specifications may not always be available. Substitutions may occur when required.

3.2 عدم مسؤولية منصة Logisty عن تفاوُت مواصفات الشاحنات:

لا تتحمَّل Logisty أي مسؤولية عن الاختلافات بين مواصفات الشاحنات المُعلَن عنها والمركبات الفعلية المقدَّمة. فالصور والأوصاف المستخدَمة لأغراض توضيحية فقط، وقد تحدث اختلافات بينها وبين الأوصاف الفعلية.

3.3 عدم توفُّر الخدمة والمسؤولية المترتبة:

في حال عدم توفر أحجام معينة من الشاحنات، ستقدم منصة Logisty بدائل مناسبة، لكنها لا تتحمَّل مسؤولية أي تأخير أو تكاليف إضافية ناتجة عن هذه التغييرات. وبناءً على ذلك، قد يكون السعر الظاهر على منصة Logisty عرضةً للتعديل.

4 Cancellation Policy:

By accepting these Terms, the Users undertake, agree and acknowledge that all the services availed by them on Logisty, will inter-alia be subject to the following cancelation charges:

4.2 Logisty Cancellation Policy for Home Move

يُعَدُّ الانتقال إلى منزل جديد عملية مُعقَّدة، وتوفر سياستنا المرونة اللازمة مع ضمان تقديم خدمة موثوقة.

تمديد فترة الإلغاء

Standard Cancellation: Cancel up to 72 hours before the move with a 5% deduction on the booking amount.
Standard cancellation - Cancellations made 48-72 hours before the move date, a 30% cancellation fee would apply
Reduced Late Cancellation Fee: For cancellations 24–48 hours before the move, a fee of 50% of the booking amount applies, or customers can opt for a free reschedule.
Same-Day Cancellation (0–24 Hours Before Move): A 100% cancellation fee applies for cancellations made within 24 hours.

5. Restricted Items:

بقبول هذه الشروط، يوافق المستخدمون ويقرّون ويتعهَّدون بأنه يُحظَر تحميل المواد التالية وفقًا للوائح دولة الإمارات وهيئة الطرق والمواصلات:

المواد الخطرة (مثل: السوائل القابلة للاشتعال، أو المتفجرات)
الأسلحة والمواد غير القانونية
السلع القابلة للتلف (ما لم يتم الترتيب عليها مَسبَقًا)
العناصر عالية القيمة (بقيمة تتجاوز 50,000 درهم إماراتي دون موافقة مُسبَقة)
الحيوانات (دون تصاريح خاصة)

وتحتفظ منصة Logisty بالحق الكامل في إضافة أو تعديل أو تغيير القائمة المذكورة أعلاه.

6. Buy Now, Pay Later (BNPL) Disclaimer

تُدار خدمات "اشترِ الآن وادفع لاحقًا"، عند توفرها، من قبل مُزوِّدي خدمات مالية مستقلين، ولا تتحمَّل منصة Logisty أي مسؤولية عن شروط أو مشكلات هذه الخدمة، حيث تُعَدُّ هذه المعاملات خارج نطاق مسؤولية منصة Logisty وتخضع لشروطها وأحكامها الخاصة.

7. Data Protection, Privacy, and Confidentiality

تمتثل منصة Logisty لقانون حماية البيانات الشخصية في دولة الإمارات العربية المتحدة (PDPL) لضمان حماية بيانات المستخدمين. لن تتم مشاركة معلوماتك الشخصية مع أطراف ثالثة إلا عند الضرورة لأغراض تشغيلية. وبالوصول إلى خدمات منصة Logisty، فإنك تُقرّ بقبولك غير المشروط وتمنح موافقتك الصريحة على ذلك.

8. License to Use Services

وفقًا للامتثال لهذه الشروط، تمنح منصة Logisty المستخدمين ترخيصًا محدودًا للوصول إلى خدماتها واستخدامها على أجهزتهم الشخصية لأغراض غير تجارية.

9. User Accounts

للوصول إلى الخدمات، يجب على المستخدمين إنشاء حساب نشط وتقديم معلومات دقيقة ومُحدَّثة عنهم. وعدم الامتثال لهذه المتطلبات قد يؤدي إلى إيقاف مُؤقَّت للخدمات.

10. Payments

جميع الرسوم المدفوعة مقابل الخدمات المحجوزة عبر منصة Logisty نهائية وغير قابلة للاسترداد، ما لم يُنَص على خلاف ذلك. تتم عمليات الدفع نيابةً عن مُزوِّد الخدمة الخارجي.

11. Disclaimers; Limitation of Liability

يتم تقديم الخدمات "كما هي" دون أي ضمانات. لا تقدم منصة Logisty أي ضمانات بشأن توفُّر الخدمات أو أدائها. تقتصر مسؤوليتها، عند الاقتضاء، على قيمة رسوم الخدمة المدفوعة على منصة Logisty.

12. Indemnity

يوافق المستخدمون على تعويض منصة Logisty وهيئة الطرق والمواصلات (RTA) وشركة TruKKer عن أي مطالبات أو أضرار تنشأ عن استخدامهم للمنصة.

13. Governing Law and Dispute Resolution

تخضع هذه الشروط لقوانين دولة الإمارات العربية المتحدة وإمارة دبي. ويتم حل النزاعات أمام محاكم دبي.

14. Amendments to Terms and Conditions

Logisty reserves the right to add, alter and amend these Terms at any time on its website/app. By accepting these Terms and with continued use of the Services, it implies acceptance of the revised Terms.

15. Location Tracking of Drivers

We collect real-time location data from drivers using the Logisty platform. This data is used to:
